DOLABANY EYEWEAR TERMS OF SALE
TERMS OF PAYMENT:
All invoices are due and payable NET on the 10th of the month. A finance charge of 1.5% monthly (annual percentage rate of 18%) will be applied to all past due balances. Accounts in good standing will receive shipment of goods. A $25.00 fee will be assessed on any checks returned to Dolabany Eyewear for non-payment or insufficient funds.
LIMITED WARRANTY:
Frames with a manufacturer’s defect will remain under warranty until the frame becomes discontinued. Dolabany Eyewear reserves the right to credit or replace the defective frame for all active accounts in good standing.
NO CASH REFUNDS:
All returns will be for exchange purposes only. Returned merchandise will not qualify as a payment towards balance due.
EXCHANGE POLICY:
Exchange orders are written by a field sales rep using a Dolabany Eyewear Return Authorization form. Dolabany Eyewear’s corporate office will issue both the Return Authorization and the Sales Order in the case of an absentee rep. Merchandise will not be exchanged if an account has an outstanding payment more than 60 days past due.
BUYING GROUP SALES:
The customer and the buying group jointly remain liable for all amounts due. In the event of default of payment by either customer or buying group, Dolabany Eyewear may proceed with collection for all unpaid sums, including collection costs and attorney fees, from either one or both parties. Both parties understand and agree that payment from one to the other is not a defense to any claim by Seller.
MERCHANDISE SALES:
Merchandise is solely sold for in- store resale and is not for resale in any other venue without prior written authorization. Furthermore, merchandise is prohibited from diversion or resale through any online retail or ecommerce website, including but not limited to sites such as eBay, Amazon, and Poshmark.
COLLECTION:
In case of default, purchaser agrees to pay Dolabany Eyewear’s attorney and/or collection costs and court fees.
CLAIMS:
Report any claim to Dolabany Eyewear within 15 days of invoice.
DAMAGED MERCHANDISE:
Refuse or report any damaged cartons received from carrier immediately at the time of delivery.
DISCONTINUED MERCHANDISE:
Discontinued frames are FINAL SALE and are not subject to exchange, credit, or warranty replacement. Dolabany Eyewear reserves the right to discontinue certain items at any time without notice.
Dolabany Eyewear reserves the right to reject any order, at any time, at its sole discretion, and demand payment prior or simultaneously with shipment. All orders are subject to corporate office approval.
PRICES:
All prices are subject to change without prior notice.
Dolabany Eyewear reserves the right to limit or terminate accounts, with the understanding that termination will not affect the obligation of an account to pay any existing balance due.
